Who is responsible for processing personal data

To what does this Privacy Statement apply?

This privacy statement applies when the data subject is

  • visits the offices, showrooms, websites of the controller
  • uses the controller’s apps and online tools or interacts with the controller in some way.
  • or when the data subject is a potential or former customer of the controller.

Processor’s websites or social media channels sometimes mention links to third-party websites (external websites, other social media, partner websites, organizers of events we sponsor, etc.) whose terms of use do not fall within the scope of this privacy statement. Therefore, the controller does not take any responsibility for any processing of personal data by these third parties.

What personal data are processed?

The controller declares to process only personal data that are pertinent or necessary for the purposes for which they are processed. Depending on the specific purposes, the controller processes, among others, the personal data listed below. These are data pertaining to the data subject that:

  • provided by the individual himself;
  • the controller assigns to the data subject for the use of its products and services;
  • the controller obtains through the data subject’s use of its products and services or;
  • received by the controller through third parties.
  • All data collected by the controller may be combined with each other to optimize its offers and services.

There are different types of personal data:

  • User data: allows the controller to identify or contact the data subject. For example: name, address, phone number, language preference, copy of the front of the identity card, fto’s showing the data subject, gender, email address, age, family composition and any other preferences expressed by the data subject through websites, social media, promotions, mobile applications, emails, contests, etc., including their financial data and data related to their creditworthiness;
  • Technical data: these are required by the controller in order to achieve proper operation of its products and services.
  • Traffic data: this particular technical data is needed by the controller to handle traffic over electronic communication networks, such as an anonymized IP address or MAC address;
  • Location data: this data allows the controller to determine the location of the data subject’s Internet access.
  • Data on data subject use: the data received by the controller when the data subject uses its products and services. For example, which products the data subject purchases. The controller uses this data, among other things, to correctly bill the data subject as a customer and to provide the data subject with a better and personalized experience.

The controller does not process sensitive data such as, among others, data on racial or ethnic origin, political opinions, sexual preferences and health of the data subject.

For what purposes are personal data processed?

The controller collects and processes the data subject’s personal data for such purposes as.

  • customer administration;
  • following up on orders/deliveries or executing the agreement between data subject and controller;
  • billing;
  • following up on solvency;
  • profiling and sending marketing and personalized advertising;
  • improving products and services of the processing controller;
  • soliciting feedback on services provided by the controller;
  • complying with legal obligations that the controller has;
  • studies, tests and statistics, for trend analysis, among other things.

On what legal basis are personal data processed?

Personal data are processed on the basis of the following articles of the General Data Protection Regulation:

  • Consent: The data subject gives consent for their personal data to be used for marketing purposes.
  • The processing is necessary for the performance of a contract to which the data subject is a party, or in order to take measures at the request of the data subject prior to the conclusion of a contract.
  • The processing is necessary to comply with a legal obligation incumbent on the controller.
  • Necessary for the fulfillment of legitimate interest to conduct business.

Who receives the personal data?

If this is necessary to achieve the predefined purposes, the personal data of the data subject will be shared with other companies within the European Economic Area that are directly or indirectly related to the controller or with any other partner of the controller.

The controller guarantees that these recipients will take the necessary technical and organizational measures to protect personal data.

With the exception of any processors as mentioned in point 1, acting solely on the instructions of the Controller or certain subcontractors or supplier depending on the specific assignment given to the Controller, the Controller shall process the personal data of the data subject solely for its own internal use. The personal data will not be sold, transmitted or communicated to third parties, unless the data subject would have given prior explicit consent.

The controller has also implemented appropriate legal and technical measures to prevent unauthorized access and use of the data subject’s personal data.

How long are personal data kept?

Personal data processed for customer management will be retained for the period necessary to comply with legal requirements (including accounting). Personal data processed for marketing purposes will be retained for a period of 365 days.

The controller retains personal data (i) As long as necessary or relevant for the purposes set forth, (ii) for the duration to which it is legally bound or (iii) until such time as a contractual relationship is ongoing, or (iv) until such time as any legal dispute or investigations may arise with respect to the services or products provided by the controller.

What rights do you have as a data subject?

Right to information

Through this Privacy Statement, the Controller wishes to inform you as fully as possible about the processing of your personal data. Your data are processed for legitimate purposes in an appropriate, relevant, secure and proportionate manner, they are not kept longer than necessary and always with the utmost integrity and confidentiality. Right of inspection

You always have the right to verify the lawfulness of any processing activity of your personal data and to ask processing controller to provide you with information about the purposes of the processing, the categories of your personal data, the categories of recipients of your personal data, the retention period and the rights you can exercise.

You also have the right to request a copy of the personal data processed about you. In principle, this copy will be provided to you free of charge unless your request would be unreasonable or excessive.

Right of improvement

You have the right to correct incorrect data or complete incomplete data upon simple request to the controller.

Right to data erasure

You have the right to request the controller to erase your personal data if there is no longer a legitimate reason for the controller to continue processing them. You can exercise this right in the following cases:

  • Your personal data is no longer necessary to fulfill the purpose sought;
  • You prove that the controller has unlawfully processed your data;
  • Your personal data should be deleted pursuant to a legal obligation;
  • You revoke your consent to process your personal data and there is no other legal basis for processing your data;
  • You have successfully exercised your right to object (see section 8.6)

However, the controller retains the right to refuse your request for deletion with justification and cannot be held liable for the fact that deleted personal data remain temporarily stored somewhere, invisible to it.

Right to restriction of data processing

You have the right to demand the restriction of data processing in any of the following circumstances:

  • You dispute the accuracy of the personal data processed by the controller and the controller has been given a reasonable time to verify the accuracy of the personal data;
  • You prove that the processing was unlawful and request a restriction;
  • The controller no longer needs the data, but you still need it to pursue a legal claim;
  • You exercise your right to object (see section 8.6)

Right to object to data processing

You have the right to oppose the processing of your personal data for “direct marketing” purposes at any time. The controller will stop processing your personal data unless it can raise compelling grounds that outweigh your rights and freedoms. If appropriate, you will also be notified.

Right to transferability of personal data

You have the right to obtain and reuse the data you provide in a structured, common and machine-readable form for other services and thus transfer it to another controller, unless this is technically impossible.

Right not to be subject to automated decision-making

You have the right not to be subjected to a fully automatic decision – without human intervention – if it significantly affects you or has legal consequences. At present, the controller declares that you will not be subjected to such automated decision-making in any of the processing activities carried out by the controller.

Does the processor use cookies?

Apart from the data that the data subject voluntarily shares with the controller when using its websites, the controller also uses cookies and other technological means that may collect personal data. More information regarding the use of cookies and the permission that is requested can be found in the cookies policy.

The data subject can visit the websites of the controller without communicating personal data, in which case no cookies are used that collect personal data from the website visitor. With his consent (insofar as there is no other legal basis), the controller may inform the data subject as a visitor to its websites about a personalized offer of products and services. Some sections or features are reserved for customers or visitors with an account. The controller then identifies the anonymized IP address and links it to the data subject’s customer data.

How can you file a complaint?

If you have certain complaints about the processing of your personal data, please first contact us directly at the email address info@MOOVUMsports.com so that we can resolve it for you.

However, should you still be dissatisfied, as a data subject you also always have the right to lodge a complaint with the Data Protection Authority (Rue du Printing Press 35, 1000 Brussels – commission@privacycommission.be).

Can this Privacy Statement change?

The Controller shall always have the right to improve or modify this Privacy Statement at any time whereby the modifications shall be immediately applicable from its publication on its website. You should (re)view this Privacy Statement at regular intervals to ascertain any updates. The continuation of your contractual relationship or use of our website or services, will be considered as acceptance of any changes made to this Privacy Statement.
